Breakaway 101
TERMS & CONDITIONS
By signing up for Breakaway PEP a division of Breakaway Hoops LLC recurring billing service (“Service”) or any of the services of Breakaway PEP you are agreeing to be bound by the following terms and conditions (“Terms of Service”). Any new features or tools which are added to the current Service shall be also subject to the Terms of Service. You can review the current version of the Terms of Service at any time here. Breakaway PEP reserves the right to update and change the Terms of Service by posting updates and changes to the website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.
Account Terms
You must provide your full legal name, current address, a valid email address and cell number, and any other information needed in order to complete the signup process. You acknowledge that Breakaway PEP will use the email address and cell phone number you provide as the primary methods for communications.
Payment of Fees
The service will be billed in recurring 30-days. Users have 72 hours to settle any issues with the billing. Invoice will be sent via email and text message for reconciliation.
Pause Payment
- You may pause your subscription at any time by texting the word, “pausepayment” to 646-503-1860. Pause payment requests must be received 7 days prior to your billing cycle date. If not, you will be billed for the month. Once the pause payment request has been received and processed, your account will be paused from recurring billing for the number of days specified.
- Pause payment can only be accommodated once per calendar year.
- May 1 is the last date for pause payment requests.
- Once the pause period has been exhausted you will be automatically billed as prior to the pause
period.
Cancellation, Refund
You may cancel your subscription at any time by texting the word, “cancellation” to 646-503-1860. Cancellation requests must be received 7 days prior to your billing cycle date. If not, you will be billed for the month. Once the cancellation request has been received and processed, your account will be suspended from the system and you will need to re-register for further programming including registration fee.
There will be no refunds granted for absences, transportation delays, inclement weather, withdrawals, or dismissals.
Requests for refund of Camp fees will be considered up to 3 weeks prior to the start of the program(s). Registration fees and down payments are non refundable.
Request for Summer Camp refund of monthly payment plan or full payment will be considered up to June 1 only. All down payments are non-refundable.
Breakaway PEP reserves the right prior to a program(s) to cancel an event due to any unforeseen reasons out of the control of Breakaway PEP. A full refund will be credited back to the original account holder.
Security
We do NOT receive or store cardholder data (defined as a cardholder’s account number, expiration date, and CVV2). We only provide a checkout page that sends that data to your merchant processor directly. We then receive a token that represents the card data but does not contain the Primary Account Number.

Waiver
In consideration of being allowed to participate in any way, and at any time in a sporting or exercise event sponsored by Breakaway PEP a division of Breakaway Hoops, LLC . The undersigned:
1. Acknowledge and fully understand that each participant will be engaging in activities that involve risk of serious injury, including permanent disability and death, and severe social and economic losses which might result not only from their own action, inactions or negligence but the actions, inactions or negligence of others, the rules of play, or the condition of the premises or of any equipment used. Further, that there may be other risks not known to us or not reasonably
foreseeable at this time.
2. Agree that prior to participating, they will inspect the facilities and equipment to be used, and if they believe anything is unsafe, will immediately advise their coach, supervisor or referee of such condition(s) and refuse to participate.
3. Assume all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability or death.
4. Understand that Breakaway PEP nor hosting facilities shall not be responsible or liable to any participants or their guest for lost or stolen articles.
5. Understand that any and all photographs, motion pictures, recordings, and/or likenesses of the undersigned captured during any and all events by Breakaway PEP its affiliated entities or contractors, and/or the media become the sole property of Breakaway PEP. I grant the right, permission and authority to Breakaway PEP to use my name and/ or child’s name such photographs, motion pictures, recordings, and/or likenesses for any legitimate purpose, including but not limited to promoting, advertising, and marketing activities. I further understand that Breakaway PEP as sole owner, has the full right to sell and/or profit from the commercial use of such photographs, motion pictures, recordings, and/or likenesses.
6. Release, waive, discharge and covenant not to sue the Breakaway PEP their directors, commissioners, referees, employees, agents, facilities and sponsors from any and all liability to the undersigned, his or her heirs and next of kin for any and all claims, demands, losses or damages on account of injury, including death or damage to property, caused or alleged to be caused in whole or in part by the negligence of Breakaway PEP or its related “releasees” enumerated above or otherwise.
COVID Waiver
I/child acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing. I/child further acknowledge that Breakaway PEP has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19. I/child further acknowledge that Breakaway PEP cannot guarantee that I/child will not become infected with the Coronavirus/Covid-19. I/child understand that the risk of
becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, staff, and other clients and their families. I/child voluntarily seek services provided by Breakaway PEP and acknowledge that I am increasing my and child risk to exposure to the Coronavirus/COVID-19. I acknowledge that I/child must comply with all set procedures to reduce the spread while attending my class.
I/child attest that:
I/child not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell. * I/child have not traveled internationally within the last 14 days. * I/child have not traveled to a highly impacted area within the United States of America in the last 14 days. * I/child do not believe I/child have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19. * I/child have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities. * I/child are following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I/child hereby release and agree to hold Breakaway PEP harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the salon, or that may otherwise arise in any way in
connection with any services received from Breakaway PEP. I/child understand that this release discharges Breakaway PEP from any liability or claim that I, my heirs, or any personal representatives may have against Breakaway PEP with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Breakaway PEP. This liability waiver and release extends to the Breakaway PEP together with all owners, partners, and employees.
Payment Acknowledgement
- I understand I have registered for subscription payments.
- I understand if my payment fails to be processed on its scheduled due date, I will have up to 72 hours to reconcile failed payment(s) or be asked to stop participation in class(es) until past and/or current payment(s) are resolved.
- I acknowledge that payments are only accepted and processed online at breakawaypep.com.
- I understand Breakaway PEP personnel (coaches, staff, or administration) do not accept any cash, money orders, or checks towards payment of classes.
- I understand my card on file will be billed on an automatic RECURRING monthly basis until I pause, deregister, or the completion of the class cycle provided in publication.
- I understand that automatic monthly recurring payments are not a stop-and-go manual generated process; it is system-processed automated billing.
- I understand there are classes that occur on an ongoing cycle (year-round); I have done my due diligence in reading, comprehending, & inquiring about the classes that occur on an ongoing cycle (year-round).
- I understand I may be billed over a holiday season when school or programming is not in session. This is part of the routine 30-day recurring billing process.
Cancelation Policy
- I understand that I must complete the cancelation process by fully completing the deregistration form in order to cancel my monthly subscription membership from a participating class(es).
- It is my responsibility to check in on my cancellation process.
- I understand the deregistration form was provided in my initial welcome email, if I am unable to find the original email, I must text 646-503-1860 to receive the deregistration form link via text to complete.
- I understand it is my responsibility to receive this deregistration link.
- I understand that I have not deregistered until the deregistration form has been fully completed; I have received confirmation from Breakaway PEP via email or text regarding my cancellation status.
- It is my responsibility to check in on my cancellation process.
- I acknowledge that a conversion with a coach(es) phone call, or email to a Breakaway PEP rep stating to cancel my registered class or payment is not sufficient and not the process of canceling class and payment(s) for classes.
- I understand & acknowledged that I will continue to be billed until the deregistration form has been completed and I have received notification via email and/or text of cancelation.
- I understand the deregistration process can take up to 7 business days to complete & I will be billed for the next payment cycle if my next payment date falls within 7 business days of the deregistration period.
- If a scheduled class was not able to take place that was out of the powers of Breakaway PEP and hosting site to proceed, along with lack of notification from Breakaway PEP via email, text, or phone, and makeup session days(s) are not possible by Breakaway PEP within a month’s time frame. Breakaway PEP will provide a full refund for only the class(es) or equivalent that was not able to take place in the current month.
Attendance Policy
- I understand it is my responsibility for my child to attend all scheduled classes.
- If I remain unclear on how to use the app, I will contact Breakaway PEP via phone or text immediately to receive instructions on how to to view my child’s attendance record.
- I understand classes are scheduled and can be viewed on Breakaway PEP attendance app provided to all registered parents/guardians.
- I understand if I am unsure of my child’s schedule, I will contact Breakaway PEP office via text or phone to obtain answers to scheduling inquiries.
- I understand as a parent/guardian it is my responsibility to know my child’s class schedule and the location of class at all times.
- I understand it is my responsibility to check my child’s attendance record for all scheduled class via the app provided by Breakaway PEP.
- I understand the app provided by Breakaway PEP is the only way to check my child’s attendance record for scheduled class. If I am unaware of how to use the app, I will review the how to check attendance provided in the original registration email by Breakaway PEP.
- If I remain unclear on how to use the app, I will contact Breakaway PEP via phone or text immediately to receive instructions on how to to view my child’s attendance record.
Make-up Class Policy
- I understand there are no make up policy for missed class(es).
- Breakaway PEP provides all class schedules prior start of programming.
Gear Policy
- I understand I am recommended to order the Breakaway PEP gear upon the completion of my initial registration.
- I understand if I have a pre-order question(s) regarding the Breakaway PEP gear, I can contact Breakaway PEP office via phone or text from the phone number found on the breakawaypep.com website.
- I understand the gear is ordered only online from breakawaypep.com/store via Squadlocker. If I have any post-order questions or inquiries regarding my Breakaway PEP gear order, SquadLocker is the point of contact for my inquiry.
